Duty of Disclosure Extends to Japan
For Japanese patent applications filed on or after September 1, 2002, the Japanese Patent Office is implementing a new Examination Guideline on "Requirement for Disclosure of Information on Prior Art Documents." The new requirement appears similar to the duty of disclosure in the U.S. under 37 C.F.R. Sec. 1.56. Official, English-language information on the new Japanese guideline can be found at http://www.jpo.go.jp/infoe/prior_art_doc.htm.
